Terms of Service
These Terms of Service (the “Terms”) govern the use of facilities provided by P.P. & Co Alfa Ballet Works (the “Operator”) for individuals who have entered into a membership agreement with the Operator (the “Member”). By using the facilities, you agree to these Terms.
Article 1 (Application of Terms)
- These Terms apply to all relationships between Members and the Operator regarding the use of the facilities.
- The Operator may establish additional rules, hours of operation, and other terms for use (the “Participation Conditions”). These Participation Conditions are considered part of these Terms, regardless of their designation.
- In the event of a conflict between these Terms and the Participation Conditions, the Participation Conditions shall prevail unless otherwise specified.
Article 2 (Membership System)
- The use of the facilities is based on a membership system.
- Individuals wishing to use the facilities (the “Applicant”) must accept these Terms and Participation Conditions and complete the necessary steps to apply for a membership agreement (the “Membership Agreement”).
- The Applicant agrees to comply with the terms set by third-party payment processors, including credit card companies and payment service providers, and consents to the authentication process by such third parties when registering payment information.
- If the Member is a minor, they must obtain the consent of a parent or legal guardian to use the facilities. Additionally, if the Member becomes an adult after consenting to these Terms as a minor, their use of the facilities is considered a ratification of all legal actions taken during their minor status.
Article 3 (Formation of Membership Agreement)
- A Membership Agreement is formed when the Applicant submits their application, and the Operator sends an acceptance notice to the Applicant.
- The Operator may refuse the application if any of the following conditions are met, and is not obligated to disclose the reason for refusal:
(1) False or incomplete application information
(2) Previous violations of these Terms
(3) The Applicant is a minor without parental or guardian consent
(4) Payment method has been suspended by the credit card company or financial institution
(5) The Applicant has been removed from services provided by the Operator’s partners
(6) Any other reasonable cause the Operator deems the application inappropriate
Article 4 (Membership Fees)
- Members must pay fees for membership, administrative costs, and usage fees (collectively “Fees”) according to the Operator’s established methods. Fees are non-refundable, except for cases caused by the Operator’s fault.
- The Operator may modify the Fees at its discretion, and the updated Fees will apply to all Members. However, exceptions may apply as specified by the Operator.
Article 5 (Membership Card)
- The Operator will issue a membership card to the Member. The Member is responsible for safeguarding the card from loss or damage. A reissue fee will be charged for lost or damaged cards.
- The Member must present the membership card when using the facilities.
- The membership card is valid only for the Member and cannot be transferred, lent, shared, or used as collateral.
Article 6 (Cancellation of Membership Agreement)
- The Operator may cancel the Membership Agreement without prior notice if the Member violates the conditions outlined in Article 4, Section 2, or engages in prohibited activities under Article 10.
- In such cases, the Operator is not responsible for any damages caused to the Member or third parties.
Article 7 (Leave of Absence)
- Members may take a leave of absence by following the Operator’s established procedures.
- Even during a leave of absence, the Member is required to pay any applicable fees according to the Participation Conditions.
Article 8 (Withdrawal)
Members wishing to withdraw must follow the withdrawal procedures as defined by the Operator. Fees are not refundable after withdrawal until the completion of the payment process.
Article 9 (Prohibited Actions)
- Members must not engage in the following actions: (1) Destruction or misuse of facility equipment. (2) Prolonged monopolization of facility equipment. (3) Excessive demands, verbal abuse, defamation, harassment, or violent behavior toward other Members, the Operator, or third parties. (4) Acts that defame the reputation of others or disrupt the order of the facility. (5) Stalking or inappropriate behavior toward others. (6) Theft, voyeurism, groping, or any other acts that violate public morals. (7) Religious or political activities within the facility. (8) Unauthorized advertising, solicitation, or commercial activities. (9) Using the facility under the influence of alcohol. (10) Any other behavior deemed inappropriate by the Operator.
- The Operator may expel Members engaging in any of the above activities without prior notice.
Article 10 (Overlap of Instructors and Schools Prohibited)
- Members enrolled in the ballet program may not participate in training under multiple instructors or schools unless explicitly permitted by the Operator.
- In the case of overlap, the Member must provide written confirmation from the other instructor or school in consultation with the Operator.
- Members who misrepresent their approval to the Operator will bear full responsibility for any consequences.
- These rules do not apply to Members participating in non-ballet programs or who are visiting Members.
Article 11 (Facility Closure)
- The Operator may close or suspend the facility for reasons such as natural disasters, necessary maintenance, or scheduled holidays.
- The Operator is not responsible for damages caused by such closures, except in cases of intentional or gross negligence.
Article 12 (Member Responsibilities)
- Members are responsible for their own health and must not use the facilities if unwell.
- Members must manage their belongings at their own risk.
- Members are responsible for resolving any damages caused to other Members or third parties.
Article 13 (Disclaimer)
- The Operator is not responsible for injuries, accidents, or theft occurring during facility use, unless caused by intentional or gross negligence.
- The Operator is not responsible for the Member’s commuting or any issues arising from personal disputes between Members.
Article 14 (Facility Closure by Operator)
- The Operator may temporarily close or suspend the facility for necessary reasons, including maintenance or unforeseen events.
- The Operator is not liable for any damages caused by such closures unless due to intentional or gross negligence.
Article 15 (Usage Restrictions and Expulsion)
- The Operator may restrict facility access or expel Members for violations of the Terms or non-payment, without prior notice.
- Members are required to compensate the Operator for any damages caused by their actions.
Article 16 (Representations and Warranties) Members must guarantee that:
- They are not affiliated with any antisocial forces.
- Their affiliates are not involved with antisocial forces.
- They will not engage in threatening, fraudulent, or disruptive behavior.
Article 17 (Changes to Terms)
- The Operator may change the Terms or Participation Conditions when necessary, notifying Members through appropriate means before the changes take effect.
- The changes will take effect from the date specified.
Article 18 (Personal Information Handling)
The Operator will handle Members’ personal information in accordance with the privacy policy.
Article 19 (Notifications)
- Notifications between Members and the Operator will be made using the method designated by the Operator.
- The Operator will consider the currently registered contact information valid unless a change is notified.
Article 20 (Transfer of Rights and Obligations)
- Members may not transfer their rights or obligations under the Membership Agreement to third parties without prior written consent from the Operator.
- If the Operator transfers the business to another party, the new entity may take over the Membership Agreement and associated rights and obligations.
Article 21 (Severability)
If any provision of these Terms is invalid or unenforceable under applicable law, the remaining provisions will remain in effect.
Article 22 (Governing Law and Jurisdiction)
- These Terms are governed by Japanese law.
- Any disputes will be resolved in the court with jurisdiction over the Operator’s principal location.
